Question: What is the quickest way of getting into Brand Registry?
Answer: Through filing your trademark in the UK or EU (only 3.5 months compared to 9-18 months in the US. UK and EU trademarks will allow you to get into amazon.com Brand Registry.
Question: How long does it take to register a trademark?
Answer: In the US, it takes at least 9 months but it’s not unusual for a trademark to take a year and even longer. In Canada it takes 24 months. In the UK and EU, it takes 3.5-4 months.
Question: Who pays government fees?
Answer: You are always responsible for paying applicable government fees. Government fees are paid separately using your credit card.
Question:What are government fees that I will need to pay in additional to professional fees?
The US government fees include:
US$275 filing fee per class, and
If we file your application based on "intent to use", i.e. future use, then extension of time fees may apply.
You should be able to file a Statement of Use stating that you started using your mark in the US within a 6-month period after a Notice of Allowance is issued.
If no Statement of Use is filed, it may be possible to obtain a 6-month extension of time.
Government fee for an extension of time to file a Statement of Use is US$125 per class per mark.
Up to 5 extensions of time may be obtained.
Government fee to file a Statement of Use is US$100 per class per mark.
The Canadian government fees include:
C$250 for filing (per mark), and
C$200 for registration (per mark) (payable before your mark is registered).
The EU government fees include:
EUR 850 for the 1st class
EUR 50 for the 2nd class
EUR 150 for each subsequent class
The UK government fees include:
GBP 170 for the first class
GBP 50 for each additional class.
Question: How do I know if my trademark is registrable?
Answer: Immediately after the purchase, we will conduct thorough trademark search and will provide you with the search results and search report. If your trademark has low chances of achieving registration, we will make some suggestions how to improve chances. You will also have the option of asking for full refund.
Question: What if I want my money back?
Answer: We will gladly offer you your money back within 2 days after purchase.
We will also refund you the money if the search shows that your mark has low chances of achieving registration. We are unable to offer refund if we have already prepared your trademark application.
Question: When is re-filing possible?
Answer: Re-filing is possible only if the Trademarks Office issued a final refusal during the examination process to register your trademark on the Principal or Supplemental Register for all of the goods and services listed in the application.
Question: What if I change my mind about pursuing my trademark? What if I decide to re-brand? What if my trademark is opposed?
Answer: If you decide to abandon your trademark, simply change your mind about pursuing your trademark registration or if you decide to re-brand, we will not re-file for free. If your trademark is opposed by a 3rd party during the opposition period and if you choose not to defend it or if you lose during the opposition proceedings, we will not be able to re-file for free.
Question: Can I re-file for different goods and services?
Answer: No, free re-filing must be done for the same goods and services. You may decide not to include some goods and services, but you may not expand the original scope of the goods and services.
Question: Can I re-file in a different country?
Answer: No, free re-filing must be done in the same country where the original application was filed.
Question: Can I ask for money-back instead?
Answer: No, we do not offer money-back. Free re-filing offer has no monetary or cash value.
Question: How soon do I need to re-file?
Answer: Free re-filing offer must be used within 6 months after a client was notified of refusal by Trademark Angel.
